Welcome to JA Passeios Nauticos. These Terms of Use and Service govern the use of the website japasseiosnauticos.com.br and the booking of the tours offered. By using this site, making a booking, or sending a message via the forms, you declare that you have read, understood, and fully accepted the conditions below.

1. Definitions

  • Platform or Site: the website japasseiosnauticos.com.br and its booking, payment, review, and contact features.
  • Contractor: JA Passeios Nauticos, a nautical tour operator based in Cabo Frio, Lakes Region – RJ, Brazil.
  • Client or User: individual who accesses the Site, makes a booking, or uses any service offered here.
  • Tour: each tourist experience available on the Platform (jet ski, boat, buggy, paramotor, diving, among others).
  • Booking: formal request made by the Client for a tour on a specific date and time, subject to confirmation upon payment.

2. Subject

The Platform allows the Client to consult available tours, choose date and time, pay online, and receive booking confirmation. The tours are operated by the Contractor or qualified partners, always under its direct coordination.

3. Capacity and Registration

To make a booking, the Client must be over 18 years old or accompanied and authorized by a legal guardian. By filling out the booking form, the Client declares that the data provided (name, email, phone, and CPF when required) is true and current.

The Platform does not require prior registration: each booking is made by filling out the form for the chosen tour.

4. Bookings

  • Availability shown on the Site is updated in real time but may change until payment confirmation.
  • A booking is only considered confirmed after payment approval by Mercado Pago.
  • Bookings paid by boleto or Pix with pending clearance remain pending until bank confirmation.
  • The Client will receive an email with the booking confirmation and meeting point instructions.
  • It is the Client's responsibility to check the tour information (date, time, number of people) before finalizing payment.

5. Payment

Payments are processed by the Mercado Pago platform. We accept the following payment methods:

  • Pix — immediate confirmation. A cash discount may apply, shown on the payment screen before checkout.
  • Credit card — single payment (1×) or installments up to 12× (with interest applied by the operator from the 2nd installment). Single-payment purchases may receive a discount, applied automatically.
  • Debit card — when enabled, with immediate confirmation.
  • Boleto bancário — when enabled, confirmation in 1 to 2 business days after payment.

Prices on the Site are in Brazilian reais (BRL) and include all applicable taxes. Any fees charged by Mercado Pago or the card-issuing financial institution are the Client's responsibility. Cash discounts are set by the Contractor and may be changed without prior notice for future bookings.

6. Pricing and Capacity

Each tour has a pricing mode defined on its detail page:

  • Per person: the total is the unit price multiplied by the number of people. Maximum number of people per booking as indicated on each tour.
  • Fixed value: total is the same regardless of the number of participants, respecting maximum capacity.
  • Per rented unit (e.g., jet ski): the Client selects how many units to rent (jet skis, buggies, etc.) and how many people will go. The total is the unit price multiplied by the number of people; the number of units determines only the contracted capacity. Each unit holds at most the number of people indicated on the tour page (e.g., 2 people per jet ski). It is not necessary to fill every unit — for example, you can rent 3 jet skis for 4 people (2+1+1).

Time-slot capacity is managed in real time. Upon booking confirmation, the corresponding units/seats are immediately debited from the chosen time slot.

7. Cancellation and Refund

The Client may request cancellation of a confirmed booking via WhatsApp or email. The refund percentage is calculated based on how far in advance the request is made relative to the tour date and time:

  • More than 7 days in advance: full refund (100%).
  • Between 3 and 7 days in advance: 70% refund (30% fee).
  • Between 24 hours and 3 days in advance: 50% refund (50% fee).
  • Less than 24 hours in advance or in case of no-show: no refund (100% fee).

The advance period is computed automatically by the system at the moment the cancellation request is processed. The policy applies to the amount actually paid by the Client (cash discounts considered).

Cancellation by the Contractor: in cases of adverse weather (rough seas, heavy rain, wind unsuitable for safe operation), operational issues (equipment failure, instructor absence), or force majeure, the Contractor will cancel the tour and the Client will be entitled, at their choice, to:

  • Full refund of the amount paid, processed by the same payment method; or
  • Reschedule to another available date and time at no additional cost, subject to availability.

The decision to cancel for safety or operational reasons rests exclusively with the Contractor and will be communicated to the Client as soon as possible via the phone/WhatsApp provided at booking.

Refunds are processed via the same payment method and may take 5 to 30 business days to reflect on the Client's statement, per Mercado Pago and the card-issuing financial institution policies. For Pix payments, the refund is credited to the original payer's Pix key.

8. Tour Execution

  • The Client must arrive at the meeting point at least 15 minutes in advance of the scheduled time.
  • Delays longer than 15 minutes may result in loss of the booking, with no refund right.
  • Use of life jacket and other safety equipment is mandatory throughout the tour.
  • Consuming alcoholic beverages before or during the tour is prohibited. The Contractor reserves the right to cancel the tour without refund if intoxication or drug use by the Client is identified.
  • Minimum age and physical fitness vary by tour and are described on each experience page.
  • Children and adolescents must be accompanied by a legal guardian.
  • People with heart conditions, pregnant women, or those with medical conditions that may be aggravated by the activity must inform us in advance and present medical clearance when requested.
  • The Contractor is not responsible for personal items lost, damaged, or wet during the tour.

9. Reviews

After the tour, the Client may publish a review. All reviews go through moderation before being displayed publicly. The Contractor reserves the right not to publish, or to remove, reviews that contain:

  • Offensive, discriminatory, defamatory, or vulgar language;
  • Content that violates third-party rights;
  • Demonstrably false information;
  • Spam, third-party advertising, or external links.

Reviews represent the Client's personal opinion and do not bind the Contractor.

10. Contact Form

Messages sent via the contact form are stored for reply and service-history purposes. The data provided (name, email, and phone) is used exclusively to return the contact and is not shared with third parties for commercial purposes.

11. Privacy and LGPD

Personal data processing by the Contractor follows the Brazilian General Data Protection Law — Law No. 13.709/2018. We collect only the data strictly necessary to provide the service:

  • Name, email, and phone: for contact and booking confirmation.
  • CPF: required by the payment operator for invoice issuance and fraud prevention. Treated as sensitive data, stored securely and accessible only to authorized personnel.
  • Booking data: tour, date, time, number of people, and amount — stored for the legal period for tax and audit purposes.

The Client may, at any time, request access, correction, deletion, or portability of their data by emailing [email protected]. Deletion may be limited where there is a legal retention obligation (e.g., invoice data).

12. Cookies

We use strictly necessary cookies for site operation:

  • Session: identifies your browsing and protects against CSRF attacks (security token).
  • Language: stores your chosen language preference (pt, en, or es).

We do not use third-party advertising tracking cookies. The Client may configure the browser to block cookies, but this may compromise parts of the Site.

13. Intellectual Property

All Site content — texts, logo, images, photos, layout, source code, and the JA Passeios Nauticos brand — is the exclusive property of the Contractor or licensed for its use, protected by Brazilian copyright and industrial property law. Reproduction, distribution, or commercial use without prior written authorization is prohibited.

14. Limitation of Liability

The Contractor strives to keep the Site available and secure but does not guarantee uninterrupted availability. We are not responsible for:

  • Temporary unavailability caused by scheduled maintenance, internet instability, cyber attacks, or fortuitous events;
  • Payment processing failures by Mercado Pago or the Client's financial institution;
  • Delays or cancellations of tours due to weather, force majeure, or maritime authority determinations;
  • Indirect, consequential, or lost-profit damages arising from the use or inability to use the Site.

15. Changes to these Terms

These Terms may be updated periodically. Relevant changes will be communicated on the Site itself, with the new effective date. Continued use of the Site after publication implies acceptance of the updated version.

16. Jurisdiction and Applicable Law

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of Cabo Frio – RJ are elected to resolve any controversy arising from these Terms, waiving any other jurisdiction, however privileged.
